If you use the Services or accept these Terms on behalf of a company, organization, minor, or other person or legal entity, you represent and warrant that you possess all authority, rights, permissions, and legally sufficient consents necessary to do so.

If you do not agree to these Terms, you must not use the Services, submit content, create or approve a project, or place an order.

By electronically accepting these Terms, you acknowledge that your electronic acceptance is intended to constitute your agreement to be legally bound by them.

Placing an order constitutes an offer to purchase the selected personalized product. The Company may accept or reject an order as permitted by these Terms and applicable law.

The Company may refuse or cancel an order before fulfillment when reasonably necessary because of suspected fraud, unlawful or prohibited Content, intellectual-property or privacy concerns, technical impossibility, pricing or system errors, inability to fulfill the order, violation of these Terms, or requirements imposed by a Third-Party Service. Any refund legally or contractually required following such cancellation will be provided in accordance with the applicable Refund Policy and law.

3. Products

3A. Digital Products & AI-Generated Content Delivery

The Services may provide digital materials including:

  • AI-assisted personalized story and comic previews
  • Generated illustrations and story content
  • Digital comic or storybook files when expressly included with a purchased product
  • Downloadable or electronically accessible materials
  • Other digital content expressly identified by the Company

Printed products may include personalized storybooks, comic books, and other made-to-order products offered through the Platform.

Digital content is considered made available when it is displayed through the Platform, made available for download, or otherwise electronically delivered to the customer.

Printed products are considered shipped when tendered to the applicable shipping carrier. Delivery occurs when the carrier records the shipment as delivered to the shipping destination supplied by the customer, subject to applicable law.

Because products are personalized and may incorporate generative artificial intelligence:

  • AI-generated results may contain reasonable artistic or stylistic variations.
  • Exact photorealistic reproduction is not guaranteed unless expressly represented otherwise.
  • Likeness, expression, pose, clothing, scenery, lighting, objects, and artistic details may vary.
  • Generated content may contain minor visual or narrative inconsistencies inherent in generative technology.
  • Customer approval of a preview constitutes acceptance of the approved preview as described elsewhere in these Terms.
  • The Company does not guarantee that independently generated results will be identical if content is regenerated.

3B. AI Generation Limitations

Artificial-intelligence-assisted generation is probabilistic. Identical inputs may produce different results.

To the maximum extent permitted by applicable law, the Company does not guarantee:

  • Identical results between generations
  • Photographic or mathematically exact likeness
  • A particular subjective artistic interpretation
  • Perfect visual continuity between every illustration
  • Complete elimination of minor anatomical, stylistic, background, lighting, or object inconsistencies inherent in generative imagery

The foregoing does not eliminate any rights or remedies that cannot lawfully be waived and does not excuse the Company from delivering the product materially represented and purchased.

3C. Input Responsibility

You are responsible for the Content you submit and represent and warrant that:

  • The Content is lawful.
  • Information and instructions you provide are materially accurate to the extent accuracy is relevant to the requested product.
  • You possess all rights, licenses, permissions, releases, and consents necessary to submit the Content and authorize its processing as contemplated by these Terms.
  • Your submission and requested use of the Content do not violate another person's copyright, trademark, privacy, publicity, contractual, or other legal rights.
  • Where another person's likeness, image, name, or personal information is submitted, you possess legally sufficient authority or consent to authorize its use for the requested personalized product.
  • Where a minor is depicted or identified, you possess legally sufficient parental, guardian, or other authorization.

3D. Service Availability

The Services may occasionally be unavailable, delayed, degraded, or interrupted because of maintenance, updates, technical failures, security incidents, excessive demand, Internet or infrastructure problems, Third-Party Service interruptions, or circumstances beyond the Company's reasonable control.

The Company does not guarantee uninterrupted or error-free availability of the Platform.

Temporary interruption of the Platform does not, by itself, entitle a customer to a refund. This provision does not limit refund or other rights arising from a Company's failure to deliver a purchased product where such rights exist under these Terms or applicable law.

3E. Third-Party AI Providers

The Company may use third-party artificial-intelligence, cloud-computing, storage, infrastructure, security, printing, payment, and other technology providers as reasonably necessary to operate the Services.

Customer Content may be transmitted to and processed by authorized Third-Party Services as necessary to provide the requested Services, subject to applicable privacy obligations and the Company's Privacy Policy.

The Company's representations concerning the collection, processing, retention, disclosure, and use of personal information and Customer Content are governed by the Privacy Policy.

4. Your Content

License to Content

You retain any ownership rights you possess in Content you submit.

You grant the Company and its authorized service providers a worldwide, non-exclusive, royalty-free license to host, copy, reproduce, transmit, process, modify, adapt, and use your Content solely to the extent reasonably necessary to operate the Services, create and fulfill your requested personalized product, provide customer support, maintain security, comply with law, enforce these Terms, and perform other uses described in the Privacy Policy.

This license does not transfer ownership of your original Content to the Company.

The Company will not use identifiable customer photographs or personalized customer Content in public advertising or marketing without authorization, except where otherwise permitted by applicable law.

Responsibility for Content

You are responsible for:

  • Maintaining copies or backups of Content you wish to preserve
  • The legality of Content you submit
  • The material accuracy of information and instructions you provide
  • Obtaining all rights, permissions, releases, and consents required for the requested use
  • Ensuring that your use of the Services complies with applicable law and these Terms

The Company is not responsible for disputes arising solely from a customer's lack of authority to submit or authorize use of Content, subject to applicable law.

Publicly Available Content

If the Services permit you to submit Content for public display, you remain responsible for that Content.

You may not submit public Content that is:

  • Illegal
  • Fraudulent or materially misleading
  • Infringing
  • Harassing or threatening
  • Defamatory
  • Obscene or otherwise prohibited by applicable law
  • Malicious or designed to interfere with the Services
  • Privacy-invasive or submitted without required authorization
  • Spam
  • Content that violates another person's intellectual-property, privacy, publicity, or other legal rights

The Company may remove, restrict, or refuse Content that it reasonably believes violates these Terms, applicable law, or Third-Party Service requirements.

Privacy Rights in Content

You represent and warrant that you possess all rights and legally sufficient permissions necessary for the Company to process the Content in accordance with your instructions and these Terms.

Submitting a photograph, likeness, name, or other identifying Content relating to another person constitutes your representation that you possess the legal authority or permission required for the requested use.

The Company employs reasonable administrative, technical, and organizational safeguards appropriate to the nature of the information processed. No Internet transmission or storage system, however, can be guaranteed to be completely secure.

Copyright Policy (DMCA)

The Company respects intellectual-property rights.

A copyright owner or authorized agent who believes Content available through the Services infringes a copyrighted work may send a notice to:

hello@becomethestory.com

The notice should include information reasonably sufficient to identify:

  • The copyrighted work claimed to have been infringed
  • The allegedly infringing material and its location
  • The complaining party's contact information
  • A statement of good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or law
  • A statement that the information supplied is accurate and that the complaining party is authorized to act for the copyright owner
  • A physical or electronic signature

The Company may remove or disable access to allegedly infringing material and may address repeat infringement as required or permitted by applicable law.

5. Applicability

These Terms apply to:

  • Access to and use of the Services
  • Creation and management of personalized projects
  • Submission and processing of Content
  • Preview generation, review, regeneration, and approval
  • Every offer and order made through the Services
  • Digital and physical products purchased from the Company

Any modification or exception to these Terms must be expressly agreed to by the Company in writing unless otherwise required by applicable law.

6. Prices & Payment

Prices

Prices are displayed before purchase. Applicable taxes, shipping charges, and other charges, if any, will be disclosed as required during checkout.

The customer is responsible for reviewing the total purchase price before submitting payment.

Price Changes

The Company may change prices prospectively at any time. A subsequent price change will not alter the price of an order already accepted and paid, except where correction is permitted by applicable law for an obvious pricing or system error.

Payment Methods

Orders must be paid through a payment method accepted by the Company's authorized payment processor.

By submitting payment information, you represent that you are authorized to use the payment method and authorize the applicable charges shown at checkout.

Production may be conditioned upon successful payment authorization and receipt of payment.

Chargebacks

If you believe a charge is unauthorized or that the Company has failed to fulfill an order, you are encouraged to contact the Company promptly so that the matter can be investigated.

Nothing in these Terms waives any chargeback or payment-dispute right that cannot legally be waived.

The Company may provide transaction records, proof of customer approval, usage records, fulfillment records, shipping records, communications, and other relevant evidence to payment processors, card networks, financial institutions, or other authorized parties when reasonably necessary to investigate or respond to a payment dispute.

7. Delivery

Physical Books

Production and shipping timeframes displayed by the Company are estimates unless expressly identified as guaranteed.

Personalized products require generation, production, printing, fulfillment, and shipping. Actual timing may be affected by customization, technical processing, order volume, printing availability, carrier operations, weather, holidays, address problems, Third-Party Services, and circumstances beyond the Company's reasonable control.

The customer is responsible for supplying a complete and accurate shipping address and for reviewing that address before completing the order.

The Company is not responsible for additional costs or failed delivery caused solely by materially incorrect or incomplete shipping information supplied by the customer, except as otherwise required by law.

If the Company cannot ship within a timeframe represented to the customer, the Company will provide any delay notice, cancellation option, consent request, refund, or other remedy required by applicable law.

Estimated production, shipping, or delivery timeframes may be displayed during the ordering process or in order communications. Such timeframes are estimates unless expressly stated as guaranteed and may vary based on production, destination, carrier service, and the other circumstances described in these Terms.

Shipping problems

Customers should promptly report products that are lost in transit, delivered damaged, materially defective, or materially different from the order.

Responsibility for a particular loss will be determined under these Terms, the applicable Refund Policy, carrier procedures, and applicable law.

The Company may require reasonable documentation, including photographs of damaged or defective products and packaging, to investigate a claim.

8. Cancellation, Returns & Refunds

Personalized and Made-to-Order Products

Products offered through the Services are personalized and made specifically according to customer-provided Content and selections. Consequently, ordinary change-of-mind returns may be restricted once personalized production has begun, subject always to rights that cannot legally be excluded.

Nothing in this section eliminates rights available for products that are damaged, materially defective, materially nonconforming, not delivered, or otherwise subject to a mandatory remedy under applicable law.

Cancellation

A customer may request cancellation before personalized production begins.

Once final production or printing has begun, an order ordinarily cannot be canceled merely because the customer changes their mind, because costs associated with producing the personalized product may already have been incurred.

The Company may nevertheless permit cancellation or provide another remedy in its discretion or where required by applicable law.

Returns & Refunds

Because physical products are personalized, returns and refunds are generally available for qualifying problems rather than ordinary changes of mind.

A customer should contact the Company promptly if a product:

  • Arrives materially damaged
  • Contains a serious printing or manufacturing defect
  • Is materially different from the product ordered because of a Company or fulfillment error
  • Is not delivered as required under applicable law

Customers should provide photographs and a description sufficient for the Company to evaluate claims involving physical damage or printing defects.

Where a qualifying claim is established, the Company may, as appropriate and subject to applicable law:

  • Replace or reprint the affected product
  • Correct the problem where reasonably possible
  • Provide a partial or full refund
  • Provide another legally appropriate remedy

9. Quality & AI-Generated Content

AI-assisted personalized artwork is inherently creative and may contain reasonable stylistic variation.

Minor artistic characteristics are not necessarily product defects. Examples may include:

  • Reasonable stylistic variations
  • Minor differences in facial expression, pose, clothing, hair, lighting, or background
  • Minor illustration inconsistencies between scenes
  • Artistic interpretation of customer-supplied photographs
  • Reasonable differences resulting from the selected art style

Printed colors, brightness, contrast, cropping, positioning, and appearance may differ somewhat from images displayed on a monitor or mobile device because of printing processes, paper, binding, screen calibration, and manufacturing tolerances.

However, this section does not exclude responsibility for a material production error, serious printing defect, failure to provide the purchased product, or other matter for which liability cannot legally be disclaimed.

10. CUSTOMER CONTENT, RIGHTS & PERMISSIONS

You retain any ownership rights you possess in original Content submitted through the Services.

By submitting Content, you represent and warrant that you possess all rights, permissions, licenses, releases, and consents necessary to submit the Content and authorize the Company and its service providers to use it as required to create, process, produce, and fulfill the requested product.

You are responsible for:

  • Uploaded photographs and images
  • Names, likenesses, and identifying information
  • Questionnaire responses
  • Story facts and descriptions
  • Prompts, requests, and instructions
  • Any third-party material supplied by you

You must not submit or request use of Content in a manner that infringes or violates:

  • Copyright
  • Trademark
  • Privacy rights
  • Publicity or likeness rights
  • Contractual rights
  • Other intellectual-property or legal rights

Submitting another person's image, likeness, name, personal information, or protected material constitutes your representation that you possess legally sufficient authority for the requested use.

For Content involving a minor, you represent and warrant that you are the minor's parent or legal guardian or otherwise possess legally sufficient authorization for the requested use.

11. Intellectual Property

The Company and its licensors retain all rights in and to the Company's pre-existing and proprietary materials, including, as applicable:

  • Website and Platform
  • Software and source code
  • Company trademarks, trade names, logos, and branding
  • Proprietary workflows, systems, templates, and technology
  • Documentation and site content
  • Other Company-owned intellectual property

Your purchase of a personalized product does not transfer ownership of the Company's Platform, software, branding, underlying technology, or other pre-existing proprietary materials.

You retain ownership of original Content you supplied to the extent you owned that Content before submission.

Subject to these Terms, full payment, applicable third-party rights, and applicable law, the Company grants you a non-exclusive license to use the final personalized generated content for ordinary personal and non-commercial purposes, including possessing, displaying, gifting, and sharing your purchased personalized book and reasonable images of it.

No license is granted to copy, reverse engineer, reproduce, distribute, resell, sublicense, or commercially exploit the Company's software, Platform, templates, branding, or proprietary technology.

Rights in AI-generated material can present legal questions and may depend upon applicable law and the circumstances of creation. Nothing in these Terms represents or guarantees that any particular AI-generated element qualifies independently for copyright protection.

12. Content Guidelines

You may not use the Services to submit, request, create, or distribute Content that the Company reasonably determines:

  • Violates applicable law
  • Infringes intellectual-property rights
  • Violates privacy or publicity rights
  • Uses another person's likeness without legally sufficient authority
  • Is fraudulent, deceptive, defamatory, threatening, or unlawfully harassing
  • Exploits or endangers a minor
  • Constitutes unlawful hate, abuse, or exploitation
  • Contains unlawful obscene material
  • Facilitates fraud, impersonation, or other unlawful activity
  • Contains malware or malicious code
  • Attempts to interfere with or circumvent Platform security
  • Violates requirements imposed by a Third-Party Service used to provide the Services

The Company may reject, suspend, remove, or cancel a project that violates these requirements.

Any refund associated with such cancellation will depend upon the circumstances, work already performed, these Terms, the Refund Policy, and applicable law.

13. DISCLAIMERS & LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND AI-ASSISTED FEATURES ARE PROVIDED SUBJECT TO THE EXPRESS COMMITMENTS MADE IN THESE TERMS AND OTHERWISE ON AN “AS IS” AND “AS AVAILABLE” BASIS.

THE COMPANY DOES NOT WARRANT THAT THE PLATFORM WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE, OR THAT GENERATIVE-AI OUTPUT WILL PRODUCE AN EXACT SUBJECTIVE OR ARTISTIC RESULT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS IMPLIED WARRANTIES TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS OR LOST BUSINESS OPPORTUNITIES, ARISING FROM OR RELATING TO THE SERVICES, EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY'S AGGREGATE LIABILITY ARISING FROM OR RELATING TO A PARTICULAR PURCHASE OR TRANSACTION WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO THE COMPANY FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

THE LIMITATIONS ABOVE DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE DISCLAIMED, EXCLUDED, OR LIMITED.

Nothing in these Terms waives a consumer right or remedy that cannot lawfully be waived.

14. Privacy & Data Protection

Personal information is collected, used, disclosed, retained, and otherwise processed as described in the Company's Privacy Policy and applicable law.

Data Retention

The Company may retain Customer Content, transaction records, account information, security records, generated materials, and other information for periods reasonably necessary to:

  • Provide and fulfill the Services
  • Maintain customer accounts and order history
  • Permit appropriate access to purchased or generated products
  • Resolve disputes and provide customer support
  • Prevent fraud and maintain security
  • Maintain business and financial records
  • Enforce agreements
  • Comply with legal, tax, regulatory, and contractual obligations

Information may be deleted, de-identified, or anonymized when no longer reasonably necessary, subject to applicable retention requirements.

Customers may submit applicable privacy or deletion requests as described in the Privacy Policy. Some information may be retained where legally permitted or required despite a deletion request.

15. Force Majeure

To the maximum extent permitted by applicable law, the Company will not be liable for delay or failure in performance caused by circumstances beyond its reasonable control, including:

  • Natural disasters and severe weather
  • Fire, flood, or other casualty
  • War, terrorism, civil unrest, or governmental action
  • Epidemics or pandemics
  • Labor disruptions
  • Internet, telecommunications, power, or infrastructure failures
  • Cyberattacks or widespread service disruptions not caused by the Company's failure to exercise legally required care
  • Shipping-carrier disruptions
  • Printing or manufacturing interruptions
  • Material failures of Third-Party Services
  • Other events beyond the Company's reasonable control

The Company will use commercially reasonable efforts to resume affected performance when practicable.

Nothing in this section eliminates any refund, cancellation, delay-notice, or other right that applicable law requires under the circumstances.

16. Changes to Terms

The Company may modify these Terms prospectively from time to time to reflect changes in the Services, business practices, technology, or applicable law.

The “Last Updated” date will identify the most recent version.

Material changes will become effective prospectively as stated when posted or otherwise communicated and will not retroactively alter the contractual terms governing a completed transaction unless permitted by applicable law or affirmatively agreed by the affected customer.

Continued use of the Services after revised Terms become effective may constitute acceptance where permitted by applicable law. Where affirmative consent is legally required, the Company will request such consent.

17. Governing Law

These Terms and disputes arising out of or relating to them or the Services are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent federal law or other applicable law requires otherwise.

Subject to any dispute-resolution provisions contained in these Terms and any rights that cannot legally be waived, judicial proceedings shall be brought in a court of competent jurisdiction in Texas, except where applicable law requires or permits otherwise.

18. Contact & Complaints

Questions, complaints, refund requests, intellectual-property concerns, and other notices relating to the Services may be submitted to:

Become The Story, LLC
Email: hello@becomethestory.com
Seguin, Texas 78155

The Company will make reasonable efforts to respond to customer inquiries promptly. Response times may vary depending upon the nature and complexity of the matter.

19. Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy, order information presented at checkout, and any additional terms or notices expressly incorporated by reference, constitute the agreement between you and the Company concerning the applicable Services and transaction and supersede prior or contemporaneous understandings concerning the same subject matter.

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or, where appropriate, severed, and the remaining provisions will remain in effect.

The Company's failure to enforce a provision on one occasion does not constitute a continuing waiver of that provision or any other provision.

You may not assign or transfer your contractual rights or obligations under these Terms without the Company's consent where such restriction is permitted by law. The Company may assign these Terms in connection with a merger, acquisition, sale of assets, reorganization, or other lawful transfer of its business.

Provisions that by their nature should survive completion, cancellation, or termination—including provisions concerning intellectual property, customer representations, payment obligations, disclaimers, limitations of liability, indemnification, dispute resolution, and accrued rights—will survive to the extent permitted by applicable law.

Headings are provided for convenience and do not alter the meaning of these Terms.

‍

20. PREVIEW REVIEW, APPROVAL & FINAL PRODUCTION

Preview Review

Before purchasing a personalized product, you may be provided an opportunity to review a preview containing selected portions of the personalized story, illustrations, layout, or other generated content.

The preview is intended to allow you to evaluate the general story direction, personalization, selected art style, character appearance, and other representative elements before approving the project for purchase and final production.

You are responsible for reviewing the preview carefully before approval, including, as applicable:

  • Names and identifying information
  • Story facts and personalization details
  • Character appearance and likeness
  • Selected artistic style
  • Narration and dialogue
  • Spelling or information derived from Content you supplied
  • Any other material issue reasonably visible in the preview

Approval

By selecting an Approve Preview, Preview Approved, Approve & Order, or substantially similar approval control, you affirm that you have reviewed the available preview and authorize the Company to proceed using the approved preview and associated project information.

Approval signifies your acceptance of the approved preview as the basis for continued generation and production, subject to the reasonable variations and limitations described in these Terms.

If you identify an issue before approval, you are responsible for using available editing or regeneration features, where offered, or contacting the Company before placing the order.

Effect of Approval

Once a preview has been approved and an order has been placed or production has begun:

  • The approved preview may become locked from further editing or regeneration.
  • The Company may rely upon the approval in generating the remaining personalized content.
  • Customer-requested changes may no longer be possible.
  • A change of mind regarding an approved artistic or creative choice does not, by itself, constitute a defect.
  • Approval does not waive rights relating to a material production error, serious printing defect, nondelivery, material failure to provide the product purchased, or any right that cannot legally be waived.

Final Generated Content

The final book may contain additional pages, scenes, illustrations, narration, dialogue, layouts, or story developments that were not included in the limited preview.

Because generative artificial intelligence is probabilistic, final generated pages may contain reasonable differences from preview pages in areas such as:

  • Pose or facial expression
  • Background details
  • Lighting and color
  • Clothing or accessory details
  • Artistic interpretation
  • Scene composition
  • Minor continuity details
  • Placement of narration or dialogue

The Company will use the approved project information, selected art style, approved preview content, selected product specifications, and applicable generation processes to create the final product.

Approval of the limited preview does not constitute an agreement that every subsequently generated page will be identical to the preview pages. Unpreviewed final pages may differ in composition and detail, but the final product must materially conform to the personalized product represented and purchased, subject to the reasonable AI-generated and printing variations described in these Terms.

Approved Content Reuse

Approved preview content may be incorporated into and reused in the final personalized product.

The Company is not required to regenerate content that the customer previously reviewed and approved solely because the customer later prefers a different creative result.

21. CUSTOMER REPRESENTATIONS, WARRANTIES & INDEMNIFICATION

Customer Representations and Warranties

By using the Services, submitting Content, approving a project, or placing an order, you represent and warrant that:

You have the legal capacity and authority to enter into these Terms.

All information you provide to the Company is materially accurate and not intentionally misleading.

You own or otherwise possess all rights, permissions, licenses, releases, and consents necessary for all Content you submit.

Your submission and requested use of photographs, names, likenesses, biographical information, trademarks, copyrighted material, or other Content does not violate another person's legal rights.

You possess legally sufficient authority to authorize the Company's use and processing of the Content as necessary to provide the Services and fulfill your order.

If Content depicts, identifies, or relates to a minor, you are the minor's parent or legal guardian or otherwise possess legally sufficient authority to authorize the requested use.

You will not use the Services to impersonate another person, misrepresent your authority, commit fraud, violate privacy or publicity rights, infringe intellectual-property rights, or engage in unlawful conduct.

You will comply with these Terms and all applicable laws in connection with your use of the Services.

Reliance on Customer Representations

The Company is entitled to reasonably rely upon the representations, permissions, information, and instructions you provide. The Company is not required to independently verify ownership, authorship, parental status, relationship, consent, licensing rights, or authority relating to every item of Content submitted through the Services unless verification is required by applicable law or the Company elects to request it. The Company's acceptance or processing of Content does not constitute a determination that the Content is lawful or that the customer possesses all required rights.

Responsibility for Third-Party Claims

You are responsible for claims arising from Content or instructions you supplied where the claim results from your lack of authority, permission, ownership, consent, or legal right to submit or authorize use of that Content. This includes, as applicable, claims involving:

Copyright infringement

Trademark infringement

Misappropriation of likeness

Right of publicity

Invasion of privacy

Defamation arising from customer-supplied statements

Unauthorized use of personal information

Violation of contractual restrictions

Unauthorized use of a minor's image or information

Fraudulent or misleading submissions

Other violations of third-party rights caused by customer-supplied Content or instructions

Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Become The Story, LLC, its owners, officers, employees, contractors, agents, service providers, successors, and assigns from and against third-party claims, demands, actions, liabilities, losses, judgments, damages, penalties, reasonable attorneys' fees, and reasonable costs arising out of or relating to:

Your breach of these Terms

Content you submit or authorize

Your violation of another person's intellectual-property, privacy, publicity, contractual, or other legal rights

Your lack of legally sufficient consent, permission, release, license, or authority

Your unlawful or fraudulent use of the Services

Your material misrepresentation concerning ownership, consent, permission, or authority

Your violation of applicable law

The Company's right to indemnification does not apply to the extent a claim results from the Company's own unlawful conduct, gross negligence, willful misconduct, or other liability that cannot lawfully be shifted to you.

Cooperation

If a claim subject to indemnification arises, the Company may provide you reasonable notice and may require reasonable cooperation in the defense or resolution of the claim. The Company may participate in the defense through counsel of its choosing at its own expense, except where applicable law or an enforceable indemnification obligation provides otherwise. You may not enter into a settlement that imposes liability, admission, payment obligation, restriction, or other material obligation upon the Company without the Company's prior written consent.
‍

22. THIRD-PARTY SERVICES, PRINTING & FULFILLMENT

Use of Third-Party Services

The Company may use independent third-party providers to perform functions necessary or useful in providing the Services and fulfilling customer orders. These providers may include, as applicable:

Artificial-intelligence and technology providers

Cloud hosting, database, storage, and infrastructure providers

Payment processors and financial-service providers

Printing and manufacturing providers

Order-fulfillment providers

Shipping carriers

Email, communications, security, analytics, and other operational service providers

The Company may transmit information and Content to authorized Third-Party Services to the extent reasonably necessary to provide the Services, process transactions, produce and fulfill orders, maintain security, comply with law, or perform other functions described in the Privacy Policy.

Printing and Manufacturing

Physical products may be printed, manufactured, packaged, or fulfilled by an independent third-party provider selected by the Company. Reasonable manufacturing variations may occur between the digital representation of a personalized product and the physical product. Such variations may include minor differences in:

Color and brightness

Contrast

Image positioning or cropping

Paper appearance

Binding

Trim

Printing alignment

Other characteristics ordinarily associated with commercial printing and manufacturing

Minor variations that fall within reasonable commercial printing or manufacturing tolerances do not, by themselves, constitute defects. This provision does not apply to serious printing defects, substantial manufacturing errors, material nonconformity with the purchased product, or other conditions for which a remedy is required under these Terms or applicable law.

Fulfillment and Shipping

The Company may use independent fulfillment providers and shipping carriers to prepare and deliver physical products. Shipping and delivery estimates are estimates unless the Company expressly states that a particular date is guaranteed. The customer is responsible for providing complete and accurate shipping information. If a shipment is delayed, lost, damaged, returned, or otherwise affected during fulfillment or transportation, the Company may reasonably investigate the circumstances and may require information or documentation necessary to process a replacement, carrier claim, refund, or other appropriate remedy. Nothing in this section eliminates any customer right or Company obligation concerning nondelivery, damaged merchandise, delayed shipment, or other matters that cannot lawfully be waived.

Third-Party Interruptions

The Company does not control every aspect of independent Third-Party Services and cannot guarantee that every such service will operate without interruption, delay, modification, error, or outage. To the maximum extent permitted by applicable law, the Company is not liable for damages caused solely by an independent Third-Party Service's acts, omissions, outages, or failures that are outside the Company's reasonable control and are not attributable to the Company's breach of these Terms or violation of applicable law. Where a Third-Party Service interruption prevents the Company from fulfilling a paid order, the Company will provide any remedy required by these Terms or applicable law.

Third-Party Terms

Certain Third-Party Services may be subject to their own legally applicable terms, policies, carrier requirements, or processing rules. Customers agree to provide information reasonably necessary for authorized providers to process payments, manufacture products, fulfill orders, deliver shipments, prevent fraud, or otherwise perform services requested by the customer. Use of a Third-Party Service does not create a contractual relationship between the customer and that provider unless the provider's applicable terms expressly establish one.

No Transfer of Company Responsibility

The Company's use of contractors or Third-Party Services does not eliminate obligations that applicable law places directly upon the Company. Nothing in these Terms should be interpreted as disclaiming responsibility that cannot lawfully be disclaimed merely because the Company used a third party to perform part of the Services.
‍

23. ACCOUNTS, SECURITY, FRAUD & SUSPENSION

Customer Accounts

Where the Services require or permit creation of an account, you are responsible for providing materially accurate account information and maintaining the accuracy of information necessary to use the Services and fulfill your orders. You are responsible for maintaining the confidentiality of your account credentials and for taking reasonable steps to prevent unauthorized access to your account. You may not:

Create an account using materially false or fraudulent information

Impersonate another person or entity

Access or attempt to access another customer's account without authorization

Sell, transfer, or misuse account credentials

Use automated or other methods to circumvent access restrictions or security controls

Use the Services for fraudulent, abusive, or unlawful purposes

Unauthorized Account Activity

You should promptly notify the Company at hello@becomethestory.com if you reasonably believe your account has been accessed or used without authorization. The Company may take reasonable measures to protect an account, including requiring authentication, temporarily restricting access, resetting credentials, preserving relevant security records, or suspending transactions while suspected unauthorized activity is investigated. Nothing in this section makes a customer responsible for unauthorized activity to the extent applicable law provides otherwise.

Fraud Prevention

The Company may use reasonable fraud-prevention and security measures to protect customers, payment transactions, the Platform, and the Company. Where reasonably necessary, the Company may investigate, delay, reject, or cancel a transaction when there is a good-faith basis to suspect:

Payment fraud

Unauthorized use of a payment method

Identity or account misuse

Materially false information

Chargeback abuse or attempted payment manipulation

Unauthorized use of another person's Content or likeness

Attempts to circumvent Platform restrictions

Security threats

Unlawful activity

Material violation of these Terms

The Company may request information reasonably necessary to verify a transaction, account, authorization, or order where permitted by applicable law.

Suspension or Restriction of Services

The Company may temporarily suspend or restrict access to all or part of the Services where reasonably necessary to:

Protect the security or integrity of the Platform

Investigate suspected fraud or unauthorized activity

Prevent harm to another person or the Company

Respond to a legal or regulatory requirement

Address infringement or privacy complaints

Prevent prohibited or unlawful Content from being processed

Enforce a material violation of these Terms

Address conduct that materially interferes with operation of the Services

Where reasonably practicable and legally appropriate, the Company may provide notice of a suspension or restriction and an opportunity to address the underlying issue.

Termination

The Company may terminate or permanently restrict an account for a material or repeated violation of these Terms, fraudulent or unlawful activity, serious security abuse, or conduct that creates a substantial risk of harm to the Company, the Services, another customer, or a third party. Termination or suspension does not eliminate payment obligations or other liabilities that accrued before termination. If the Company terminates an account or cancels an unfulfilled paid order, any refund due will be determined according to the reason for termination, work already performed, the Refund Policy, these Terms, and applicable law.

Preservation of Records

The Company may preserve account, transaction, security, order, approval, communication, and other relevant records when reasonably necessary to investigate suspected fraud, resolve disputes, establish transaction history, enforce these Terms, protect legal rights, or comply with applicable law. Retention and processing of personal information remain subject to the Company's Privacy Policy and applicable law.
‍

24. DISPUTE RESOLUTION

Informal Resolution of Disputes

The Company values the opportunity to address customer concerns promptly and directly. If a dispute, claim, or controversy arises out of or relates to the Services, these Terms, a personalized project, an order, or a transaction with the Company, you and the Company agree to make a good-faith effort to resolve the matter informally before initiating formal legal proceedings, to the extent permitted by applicable law. A customer seeking informal resolution should contact:
‍
‍Become The Story, LLC
Email: hello@becomethestory.com
Seguin, Texas 78155

‍
The notice should include information reasonably sufficient to identify the applicable customer, project, or order and should describe the nature of the concern and the resolution requested.

Opportunity to Resolve

After receiving notice of a dispute, the Company will have a reasonable opportunity to investigate the matter and attempt to resolve it directly with the customer. The parties agree to cooperate reasonably and in good faith in attempting to resolve the dispute. Except where immediate action is reasonably necessary or applicable law provides otherwise, the parties agree to allow up to 30 days after receipt of a written dispute notice for informal resolution before commencing formal legal proceedings. Nothing in this section prevents either party from taking action necessary to preserve a legal claim before an applicable limitation period expires, seeking legally available emergency or injunctive relief, pursuing an eligible matter in small claims court, reporting a matter to an appropriate governmental authority, or exercising a right that cannot legally be restricted.

Unresolved Disputes

If the parties are unable to resolve a dispute informally, either party may pursue any remedy available under these Terms and applicable law. Any court proceeding will be subject to Section 17 — Governing Law and any other applicable provisions of these Terms. Nothing in these Terms requires a customer or the Company to submit a dispute to mandatory arbitration unless the parties separately and voluntarily agree to arbitration after a particular dispute has arisen.

Individual Resolution

To the extent permitted by applicable law, the parties are encouraged to resolve disputes based upon the particular facts and circumstances of the individual customer, transaction, project, or order involved. Nothing in this section is intended to waive, restrict, or eliminate any right or remedy that applicable law does not permit the parties to waive.

Continued Customer Support

Submitting a complaint or dispute does not prevent a customer from contacting the Company for ordinary customer support or attempting to resolve the matter directly. The Company may offer an appropriate resolution depending upon the circumstances, which may include correction, replacement, reprinting, refund, partial refund, account adjustment, or another appropriate remedy, without admitting liability.

25. CONSUMER REVIEWS & FEEDBACK

Customer Reviews

The Company may provide customers with opportunities to submit reviews, ratings, testimonials, comments, photographs, or other feedback concerning the Services or products. License for Submitted Reviews

If you voluntarily submit a review, testimonial, rating, comment, or other feedback for publication, you grant the Company a non-exclusive, worldwide, royalty-free license to reproduce, display, format, and publish that material on websites, social-media accounts, email communications, and other promotional channels owned or controlled by Become The Story for purposes of presenting or promoting customer feedback and the Services, subject to applicable law.

This license does not transfer ownership of your original review or other material to the Company. The Company will not materially alter the substance of a customer's review in a manner that falsely changes the customer's expressed opinion.

Customer Photographs and Testimonials

The Company will not use private photographs or personalized Content originally supplied for creation of a book as a public testimonial, advertisement, endorsement, or other public promotional material merely because the customer uploaded that Content to create a product. If the Company wishes to use an identifiable customer photograph, likeness, personalized book image, or other private customer Content for public advertising, endorsement, or promotional purposes, the Company will obtain any authorization required under applicable law. If the Company later offers a feature through which a customer separately and voluntarily submits photographs or other media specifically for public review or promotional display, the applicable submission process may request separate permission for that use.The Company will not use private photographs or personalized Content originally supplied for creation of a book as a public testimonial, advertisement, or promotional endorsement merely because the customer uploaded that Content to create a product.

This restriction does not prevent the Company from publishing photographs or other materials that a customer separately and voluntarily submits for publication as part of a review, testimonial, promotion, or other public-facing feature, subject to applicable law.

Incentivized Reviews

If the Company offers a discount, promotional benefit, sweepstakes entry, free product, or other incentive in exchange for submitting a review, the incentive will not be conditioned upon the review being positive. Feedback and Suggestions

If you voluntarily provide ideas, suggestions, recommendations, or other feedback concerning improvements to the Services, the Company may consider and use that feedback without an obligation to compensate you, provided that doing so does not give the Company ownership of your pre-existing intellectual property or private Customer Content. Nothing in this provision requires the Company to implement a suggestion or maintain confidentiality regarding unsolicited general business or product suggestions unless the parties separately agree otherwise.
